Not after reading something that just stopped me in my tracks.<\/p>\n<p>Please don\u2019t tell <a title=\"small business expert interview anita campbell\" href=\"https:\/\/forum.web.com\/secrets-of-success\/\">Anita<\/a> that I had to hit the pause button today on the franchise trends article. Okay?<\/p>\n<p>&nbsp;<\/p>\n<h2>A Cockamamie Franchise Idea<\/h2>\n<p>I\u2019ve been in <a title=\"franchising loans\" href=\"https:\/\/www.thefranchiseking.com\/applying-for-a-franchise-loan\">franchising<\/a> long enough to hear my share of nutty ideas.<\/p>\n<p>I won\u2019t bore you with them now, because <i>I can\u2019t type these words in fast enough<\/i> concerning<strong> a cockamamie franchise idea<\/strong> I just read about that has to do with funding start-up franchises. Check this out\u2026<\/p>\n<p>&nbsp;<\/p>\n<h2>The Headline<\/h2>\n<p><strong><i>A Thousand Bucks To Become an Owner Of Forever Yogurt<\/i><\/strong><\/p>\n<p><a title=\"headline writing carol tice\" href=\"https:\/\/www.makealivingwriting.com\/write-headlines-irresistible-big-money-clients-beg-write\/\" target=\"_blank\" rel=\"noopener\">Nice headline<\/a>. It got my attention.<\/p>\n<p>It also got my <em>super-skeptical-this-must-be-some-type-of-scam radar<\/em> fired up, too.<\/p>\n<p>So, I scanned the article-looking for the small print\u2026<\/p>\n<p>&nbsp;<\/p>\n<h2>The Premise For This Cockamamie Franchise Idea<\/h2>\n<p><a title=\"franchise ownership for $1,000\" href=\"https:\/\/www.chicagogrid.com\/features\/thousand-bucks-owner-yogurt\/\" target=\"_blank\" rel=\"noopener\">For only $1,000<\/a>, <em>you<\/em> can own a piece of a frozen yogurt franchise.<\/p>\n<p><b>Benefits:<\/b><\/p>\n<ul>\n<li>You get to have a say in the business<\/li>\n<li>You get a percentage of the profits<\/li>\n<li>You get to tell your friends and relatives that you\u2019re an \u201c<i>owner<\/i>\u201d<\/li>\n<\/ul>\n<p>So far, so good, right?<\/p>\n<p><strong>Then there\u2019s this:<\/strong><\/p>\n<p>Each investor will have to get a copy of the <a title=\"franchise document required by law\" href=\"https:\/\/www.thefranchiseking.com\/franchising-is-a-scam\">Franchise Disclosure Document<\/a>. (FDD)<\/p>\n<p>That means if 250 people each pony up $1,000, all of them will have to (<em>or should<\/em>) hire a franchise lawyer to look their FDD&#8217;s over.<\/p>\n<p>&nbsp;<\/p>\n<h2>Hold On There Franchise King<\/h2>\n<p><a href=\"https:\/\/www.thefranchiseking.com\/wp-content\/uploads\/2011\/06\/sobcrown1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-3249\" alt=\"The Franchise King, in Chicago\" src=\"https:\/\/www.thefranchiseking.com\/wp-content\/uploads\/2011\/06\/sobcrown1-300x200.jpg\" width=\"300\" height=\"200\"><\/a><\/p>\n<p>Before you start the \u201c<i>C\u2019mon Joel, why would a person who\u2019s only investing $1,000 in a franchise need to pay a franchise lawyer $500 to look the FDD over for them and give them recommendations<\/i>?\u201d stuff\u2026<\/p>\n<p>I have an answer for you:<\/p>\n<p><strong>Protection<\/strong>.<\/p>\n<p>I know\u2026I know. Losing $1,000 on a business investment is really no big deal.<\/p>\n<p>Unless the franchise business gets sued.<\/p>\n<p>Before you say \u201c<em>Franchisees can only lose what they have put in<\/em>,\u201d are you <em>sure<\/em> about that?<\/p>\n<p>I\u2019m not <a title=\"franchise lawyer directory\" href=\"https:\/\/www.thefranchiseking.com\/using-the-right\">a lawyer<\/a>. So, I\u2019m not sure if that statement is true or not.<\/p>\n<p>&nbsp;<\/p>\n<h2>The FDD<\/h2>\n<p>There are (<i>by law<\/i>) 23 items that have to be included in the FDD. They are:<\/p>\n<ol>\n<li>The Franchisor, its Predecessors, and its Affiliates<\/li>\n<li>Business Experience<\/li>\n<li>Litigation<\/li>\n<li>Bankruptcy<\/li>\n<li>Initial Franchise Fee<\/li>\n<li>Other Fees<\/li>\n<li>Initial Investment<\/li>\n<li>Restrictions on Sources Of Products And Services<\/li>\n<li>Franchisee\u2019s Obligations<\/li>\n<li>Financing<\/li>\n<li>Franchisor\u2019s Obligations<\/li>\n<li>Territory<\/li>\n<li>Trademarks<\/li>\n<li>Patents, Copyrights and Proprietary Information<\/li>\n<li>Obligation to Participate In The Actual Operation Of The Franchise Business<\/li>\n<li>Restrictions on What The Franchisee May Sell<\/li>\n<li>Renewal, Termination, Transfer and Dispute Resolution<\/li>\n<li>Public Figures<\/li>\n<li>Earnings Claims<\/li>\n<li>List Of Outlets<\/li>\n<li>Financial Statements<\/li>\n<li>Franchise Contract<\/li>\n<li>Receipt<\/li>\n<\/ol>\n<p>Call me <em>crazy<\/em>, but is sure looks to me that there\u2019s a lot of crucial information in an FDD that every franchisee-no matter how much they\u2019re investing, needs to fully understand. Plus, unless I\u2019m just being paranoid (<i>which has happened before<\/i>) there sure seems to be an awful lot of potential liability here. In the future, too.<\/p>\n<p>&nbsp;<\/p>\n<h2>Ego-Driven Micro-Franchisees<\/h2>\n<p>Some people may end up investing in this frozen yogurt franchise-and potentially other franchise concepts (<em>because this guy has a crowdfunding company<\/em>) just to be able to tell others, \u201c<i>I own a franchise<\/i>.\u201d<\/p>\n<p>As cool as it may sound to some people, I wonder if any real value can be realized from owning a teeny-tiny piece of a franchise business unit.<\/p>\n<p>By value I mean income.<\/p>\n<p>&nbsp;<\/p>\n<h2>A Fan of Franchise Crowdfunding<\/h2>\n<p>I\u2019m <em>not<\/em> a fan of <a title=\"franchise crowdfunding\" href=\"https:\/\/en.wikipedia.org\/wiki\/Crowdfunding\" target=\"_blank\" rel=\"noopener\">franchise crowdfunding<\/a>. The math just doesn&#8217;t work-especially for single-unit opportunities. That\u2019s because there\u2019s just not enough money to go around-especially during the first couple of years.<\/p>\n<p><strong>Example:<\/strong><\/p>\n<p>Let\u2019s say that <a title=\"yogurt franchises for sale\" href=\"https:\/\/www.thefranchiseking.com\/frozen-yogurt-franchise-fantasies\">a frozen yogurt franchise<\/a> does a bang-up job in its first year and does $350,000 in sales.<\/p>\n<p>The franchisor will probably receive 5% of that in royalties. (<em>$17,500<\/em>)<\/p>\n<p>There are lots of expenses in food franchising; rent, inventory, supplies, payroll, taxes, professional fees, and several other assorted things the franchisee-or in the case, <em>the franchisees<\/em> will need to shell out.<\/p>\n<p>How much is going to be left?<\/p>\n<p>How much can <em>each<\/em> franchisee make?<\/p>\n<p>Remember, these micro-franchisees only own a small piece of the franchise.<\/p>\n<p><strong>Pause.<\/strong><\/p>\n<p>For a moment, let\u2019s forget this cockamamie franchise crowdfunding idea.<\/p>\n<p>Let\u2019s pretend that this is a one-owner frozen yogurt franchise. If the owner had to take out a small business loan, and pay all the expenses I listed above, how much do you think there would be left after the first year in business?<\/p>\n<p><strong>The answer:<\/strong><\/p>\n<p>Not much. If, anything.<\/p>\n<p>But, things should get better in year 2, year 3, etc.<\/p>\n<p>Maybe the franchisee can pull out $40,000 in year two and $60,000 in year 3. <em>Maybe<\/em>.<\/p>\n<p>Based on that, 250 franchisees that each put in $1,000 would earn around $240 in year 3 of being in business.<\/p>\n<p>Now, if they <em>wisely<\/em> sat down with a franchise lawyer who charged $500 to look over the FDD-and make some recommendations, the micro-franchisee still hasn&#8217;t made a dime.<\/p>\n<p>&nbsp;<\/p>\n<h2>Confession: I Only Made It To Pre-Algebra<\/h2>\n<p>I\u2019m not a math whiz. Never was.<\/p>\n<p>My junior high school math department refused to allow me to take any other math classes after I flunked out of pre-algebra.<\/p>\n<p>So, my math skills are of the simple variety. So, maybe I missed something in my computations.*<\/p>\n<p>*Please tell me if I did, and show me where I\u2019m wrong.<\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"https:\/\/www.thefranchiseking.com\/wp-content\/uploads\/404.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-6058\" alt=\"That Darn Link!\" src=\"https:\/\/www.thefranchiseking.com\/wp-content\/uploads\/404-168x300.jpg\" width=\"168\" height=\"300\"><\/a><\/p>\n<p>&nbsp;<\/p>\n<h2>I Got It!<\/h2>\n<p><i>I\u2019m such an idiot<\/i>.
