Hire a Franchise Lawyer Before You Buy a Franchise"},"content":{"rendered":"<p><a href=\"https:\/\/www.thefranchiseking.com\/top-franchise-systems\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-28997 size-full\" src=\"https:\/\/www.thefranchiseking.com\/wp-content\/uploads\/buying-a-franchise-checklist.png\" alt=\"franchise checklist\" width=\"436\" height=\"640\" srcset=\"https:\/\/www.thefranchiseking.com\/wp-content\/uploads\/buying-a-franchise-checklist.png 436w, https:\/\/www.thefranchiseking.com\/wp-content\/uploads\/buying-a-franchise-checklist-204x300.png 204w\" sizes=\"auto, (max-width: 436px) 100vw, 436px\" \/><\/a><\/p>\n<p>There are several things to do before you buy a franchise.<\/p>\n<p>In this case, I&#8217;m <em>not<\/em> referring to things like:<\/p>\n<ul>\n<li>Putting together your strengths and personal traits worksheet<\/li>\n<li>Having a heart-to-heart meeting with your spouse<\/li>\n<li>Doing your <a href=\"https:\/\/www.thefranchiseking.com\/calculator\">net worth calculations<\/a><\/li>\n<li>Having discussions about your budget<\/li>\n<li>Doing your franchise research<\/li>\n<li><a title=\"calculators\" href=\"https:\/\/www.thefranchiseking.com\/franchise-business-plans\">Writing<\/a>\u00a0your business plan<\/li>\n<\/ul>\n<p>And more.<\/p>\n<p>Instead, I&#8217;m referring to something that&#8217;s often skipped, but <strong>never<\/strong> should be. Something that can <a href=\"https:\/\/www.thefranchiseking.com\/new-york-state-senate-bill-s7289\">prevent a lot of headaches<\/a>.<\/p>\n<p>But you&#8217;ll need to <del>spend<\/del> invest money to do it.<\/p>\n<h2>Hire a Franchise Lawyer Before You Buy a Franchise<\/h2>\n<p>I&#8217;ve always been troubled by people who contact me <em>after<\/em> they buy a franchise-who want to know how they<em>\u00a0&#8220;can get out of their franchise agreements<\/em>.&#8221;<\/p>\n<p>Seriously?<\/p>\n<p>&#8220;<em>I think I bought the wrong franchise a few months ago. Can you help me sell it?<\/em>&#8221;<\/p>\n<p>&#8220;<em>They&#8217;re talking about suing me for non-payment of royalties. What do I do now<\/em>?&#8221;<\/p>\n<p>&#8220;<em>They just sold a new franchise that&#8217;s only 2.5 miles away! I thought my territory was protected. What can I do?<\/em>.&#8221;<\/p>\n<p>&#8220;<em>There&#8217;s too much selling involved. I&#8217;m not very good at it<\/em>. <em>Can you help me <a title=\"get out of a franchise\" href=\"https:\/\/www.marketwatch.com\/story\/thinking-about-a-franchise-key-mistakes-to-avoid-2013-04-19\" target=\"_blank\" rel=\"noopener noreferrer\">get out<\/a> of my agreement<\/em>?&#8221;<\/p>\n<p>Those are only a few examples of the calls and emails I receive.<\/p>\n<p>In almost every case, these franchisees didn&#8217;t do enough <a title=\"research on franchises forbes.com\" href=\"https:\/\/www.forbes.com\/sites\/jimblasingame\/2017\/03\/25\/the-first-four-things-you-must-know-before-buying-a-franchise\/#745a34831f21\" target=\"_blank\" rel=\"noopener noreferrer\">research<\/a> (<em>or the right kind of researc<\/em>h), and didn&#8217;t <a href=\"https:\/\/www.thefranchiseking.com\/do-you-need-a-franchise-lawyer\">use<\/a> a franchise attorney. They just bought the franchise. And once that&#8217;s done, once they&#8217;ve purchased the franchise, there&#8217;s not much I can do.<\/p>\n<p><a href=\"https:\/\/www.thefranchiseking.com\/wp-content\/uploads\/call-the-franchise-king.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-28993\" src=\"https:\/\/www.thefranchiseking.com\/wp-content\/uploads\/call-the-franchise-king.jpg\" alt=\"best franchise advice\" width=\"640\" height=\"414\" srcset=\"https:\/\/www.thefranchiseking.com\/wp-content\/uploads\/call-the-franchise-king.jpg 640w, https:\/\/www.thefranchiseking.com\/wp-content\/uploads\/call-the-franchise-king-320x207.jpg 320w, https:\/\/www.thefranchiseking.com\/wp-content\/uploads\/call-the-franchise-king-620x401.jpg 620w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/a><\/p>\n<p><strong>Tip:<\/strong> <a title=\"call the franchise king\" href=\"https:\/\/www.thefranchiseking.com\/free-strategy-call\">Call me<\/a> BEFORE you buy a franchise. That&#8217;s when I can <em>really<\/em> help.<\/p>\n<h2>Don&#8217;t Be Cheap!<\/h2>\n<p>If you don&#8217;t want any surprises, hire <a href=\"https:\/\/www.thefranchiseking.com\/find-a-franchise-attorney\">a franchise lawyer<\/a>. I have yet to hear a good enough reason not to.<\/p>\n<h3><span style=\"color: #cb0003;\">Warning!<\/span><\/h3>\n<p>If a franchise consultant or someone at franchise headquarters <em>ever<\/em> tells you that &#8220;<em>You don&#8217;t need a franchise attorney, because our franchise agreements are non-negotiable<\/em>,&#8221; or something similar, <strong>hire a franchise attorney<\/strong>.<\/p>\n<p>Without exception, the only person who can properly protect you (<em>legally<\/em>) when you purchase a franchise is a competent franchise lawyer. The fact that a franchise agreement is or is not negotiable has nothing to do with my last statement. <strong>You need legal protection<\/strong>. Period.<\/p>\n<p>That said, <a title=\"are franchise agreements negotiable?\" href=\"https:\/\/www.thefranchiseking.com\/top-franchise-attorneys\">as you can see here<\/a>, franchise agreements may have some wiggle-room. But when you hire a lawyer who specializes in franchising, negotiating your <a title=\"franchise agreement\" href=\"https:\/\/www.thefranchiseking.com\/franchise-agreement-afraid\">franchise contract<\/a>\u00a0is only one of several reasons you need to do it.<\/p>\n<p>Simply put, these are the main reasons to hire a franchise attorney:<\/p>\n<p>A. Review the FDD<br \/>\nB. Study the franchise agreement<br \/>\nC. Negotiate the details<br \/>\nD. In other words, you don\u2019t want to hire a &#8216;general attorney&#8217;\u00a0for this important task. Don\u2019t even think about asking your attorney Uncle or friend to &#8216;look things over,&#8217; if they don\u2019t have any experience with franchise documents and franchise contracts. This is MUCH too important a decision for you to get free advice that\u2019s not relevant to franchising. <strong>This is not the time to be cheap<\/strong>.
