For the first time, the Maryland Franchise Law addresses the imbalance of power between franchisees and franchisors within the ongoing relationship, by prohibiting a franchisor from restricting or inhibiting Maryland franchisees from associating with other franchisees within their brand for the franchisees\u2019 common benefit \u201cfor any lawful purpose\u201d \u2014 which could include collectively raising grievances with the franchisor for the franchisees\u2019 mutual benefit.\u00a0<\/em><\/p>\n\n\n\n

Beyond the initial sale, Maryland law also offers robust protections governing the ongoing relationship between a franchisor and a franchisee. The law mandates that a franchisor can only terminate a franchise agreement for “good cause<\/em>,” preventing arbitrary cancellations. <\/p>\n\n\n\n

Furthermore, if a franchisor violates the law in terminating the agreement, they may be required to repurchase the franchisee’s inventory. These relationship laws provide franchisees in Maryland with a level of security and legal recourse that is not available in many other states.<\/p>\n\n\n\n
